Terms of Service

All services provided by Hostcell.net may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The client agrees to indemnify and hold harmless Hostcell.net from any claims resulting from the use of service which damages the client or any other party.

Web Hosting Terms of Service

The following terms apply to any customer of any web hosting service provided by Hostcell.net.

By activating a hosting account with Hostcell.net, you agree to the the following terms. Upon requesting activation of an account, you are required to accept these terms, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

If you sign up for an account and fail to comply with these terms, no refunds will be given.

As a provider of web site hosting and other internet related services, Hostcell.net offers its clients and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. Hostcell.net respects that the internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, Hostcell.net reserves the right to take certain preventive or corrective actions.

In order to protect these competing interests, these acceptable use guidelines are clearly laid out below.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When clients obtain information through the internet, they must keep in mind that Hostcell.net cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the client must exercise his or her best judgment in relying on information obtained from the internet, and also should be aware that some material posted to the internet may be sexually explicit or otherwise offensive. Because Hostcell.net cannot monitor or censor the internet, and will not attempt to do so, Hostcell.net cannot accept any responsibility for injury to its clients resulting from inaccurate, unsuitable, offensive or illegal internet communications.

When clients disseminate information from the Internet, they must keep in mind that Hostcell.net does not review, edit, censor or take responsibility for any information its clients may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over Hostcell.net's network and may reach a large number of people, including both clients and non-clients of Hostcell.net, clients' postings to the internet may affect other clients and may affect Hostcell.net's goodwill, business, reputation or operations.

Acceptable Use

For these reasons, the following activities are strictly prohibited, and any customer found to be in violation of any of these policies is subject to immediate suspension or termination without notice.

  • Spamming
    Sending unsolicited bulk email is not only harmful because of its negative impact on consumer attitudes toward Hostcell.net, but also because it can overload Hostcell.net's network and disrupt service to Hostcell.net's clients. Should a complaint be received, Hostcell.net will investigate and may suspend or terminate any account that is determined to be faciliting the sending of spam. A $500 charge for violating this policy will be charged to the person or persons faciliting the sending of the spam, and Hostcell.net reserves the right to prosecute for this violation. A $1 per spam message charge will be assessed sent should Hostcell.net choose to pursue and prosecute.
  • Open SMTP Relays
    Maintaining an open SMTP relay is prohibited, and should an open relay be used by the client, they will be liable for its use to send any spam messages as outlined above.
  • Audio and Video Streaming
    Streaming of audio and video on any of Hostcell.net's shared hosting services.
  • Adult Content
    Hostcell.net does not allow adult content.
  • Large File Policy
    Our shared hosting plans are not for file hosting and distribution. As such, customers may not host any files that are observed to be available for the sole purpose of download. Such files include but are not limited to .iso, .rar, .zip, audio, and video files. If you are unsure whether your file is against this policy, please contact us prior to uploading.
  • Obscene Speech or Materials
    Using Hostcell.net's network to advertise, transmit, store, post, display, or otherwise make available any obscene speech or material is prohibited. Hostcell.net will notify law enforcement agencies when it becomes aware of the presence of illegal material on its network.
  • Defamatory or Abusive Language
    Using Hostcell.net's network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.
  • Forging of Headers
    Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
  • Hacking
    Any attempts to gain unauthorized access to any computers or networks belonging to another party, or attempting to breach the security of another party's system. This also includes any precursors to these attempts, such as port scans and other information gathering activities.
  • Destructive Activities
    Distributing information regarding the creation of and sending viruses, worms, trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.
  • Facilitation of Violation of these Terms
    Making available any software, program, product or service that is designed to violate these terms of service.
  • Export Control Violations
    Exporting encryption software to points outside the United States.
  • Other Illegal Activities
    Engaging in any activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.
  • IRC
    We do not allow IRC or IRC bots to be operated on our servers.
  • Harmful Activities
    Engaging in activities, lawful or unlawful, that Hostcell.net determines to be harmful to its clients, operations, reputation, goodwill or customer relations.
  • Resource Usage
    Any client who is determined to be engaging in acts that are harmful to Hostcell.net's equipment, network, or other clients may be suspended or terminated without notice.

Billing

On or before the renewal date of each billing cycle, Hostcell.net shall either:

  • Automatically debit the client's payment information on file.
  • Deliver by e-mail or regular mail an invoice for the applicable fees for the services rendered. When an invoice is delivered, payment shall be submitted to Hostcell.net no later than the due date indicated on the invoice.

It is the client's responsibility to ensure they have the funds available should they register payment information with Hostcell.net. In the event that the client has provided invalid payment information, we will send an e-mail notification, at which point we will need to be provided with new payment information within 24 hours. Should we not receive a response within 24 hours, the account will be considered overdue and may be suspended or terminated at our discretion.

Hostcell.net reserves the right to suspend and/or terminate any service with us should the client fail to make timely payments.

Fees

  • Setup Fees
    Certain services may carry a setup fee, which must be paid by client in order to make use of said services. If a client terminates the agreement, the client shall still be responsible for any outstanding fees owed to Hostcell.net.
  • Recurring Costs
    Because most of our services are provided on a recurring basis, the client will be responsible for service fees incurred each billing cycle, regardless of when the client provides notice of termination.
  • Cancellations
    We do not refund partial monthly fees to accounts. We require 30 days notice for a cancellation.
  • Account Reactivation
    Any account deactivated due to non-payment may incur a reactivation fee based on difficulty of the reactivation process.

Liability

Hostcell.net shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Hostcell.net's equipment being unavailable for any reason. Furthermore, Hostcell.net shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any data from any of Hostcell.net's equipment.

Violations

Violations of these policies should be reported to our abuse department at abuse [at] Hostcell.net. All complaints will be investigated promptly. Failure to follow any of these terms is grounds for immediate account suspension or termination.
